1. Scope of Application

These General Terms and Conditions apply to all orders placed by consumers or businesses through the online shop of Telges Corse GmbH, Industriestraße 30, 68519 Viernheim, Germany.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or self-employed professional activity.

A business is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their commercial or self-employed professional activity.

Any terms and conditions of the customer that deviate from these General Terms and Conditions shall not apply unless Telges Corse GmbH has expressly agreed to their validity.

2. Contractual Partner

The purchase contract is concluded with:

3. Offers and Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to submit an order.

By submitting an order, the customer makes a binding offer to conclude a purchase contract for the goods contained in the shopping cart.

The customer will receive an electronic confirmation of receipt immediately after submitting the order. This confirmation of receipt does not constitute acceptance of the customer's offer unless acceptance is expressly declared therein.

The purchase contract is concluded when Telges Corse GmbH accepts the customer's offer by expressly confirming the order or by dispatching the goods.

If an ordered item is unavailable, the customer will be informed without undue delay. Any payment already made will be refunded without undue delay.

4. Prices and Shipping Costs

The prices stated on the product pages include statutory VAT, where the customer orders as a consumer.

Shipping costs may be added to the stated prices. The amount of the shipping costs will be clearly displayed to the customer before the order is submitted.

For deliveries to countries outside the European Union, additional customs duties, import taxes or other charges may apply. The customer shall bear these costs where applicable.

5. Payment Terms

The payment methods available in the online shop are displayed to the customer during the ordering process.

Unless otherwise stated for the respective payment method, payment is due immediately upon conclusion of the contract.

Where a payment method is provided through an external payment service provider, the terms and conditions of the respective payment service provider shall also apply.

Telges Corse GmbH reserves the right to exclude individual payment methods in individual cases or to offer only certain payment methods.

6. Delivery and Delivery Time

Delivery shall be made to the delivery address provided by the customer.

The expected delivery time is stated in the respective offer or during the ordering process.

If delivery is delayed due to circumstances beyond the control of Telges Corse GmbH, the customer will be informed accordingly.

For business customers, the risk of accidental loss or accidental deterioration of the goods shall pass to the customer upon handover of the goods to the transport company.

The statutory provisions governing the transfer of risk shall apply to consumers.

7. Retention of Title

The goods shall remain the property of Telges Corse GmbH until full payment has been received.

For business customers, the retention of title shall also apply to claims arising from ongoing business relationships, insofar as legally permissible.

8. Liability for Defects

The statutory rights relating to defects shall apply.

If the goods delivered are defective, the customer shall initially be entitled to supplementary performance in accordance with the statutory provisions.

For business customers, the limitation period for claims based on defects in newly manufactured goods shall generally be one year from delivery, insofar as legally permissible.

The customer's statutory rights in cases of fraudulent concealment of a defect or an expressly provided guarantee shall remain unaffected.

9. Information Regarding Vehicle Parts

Before placing an order for vehicle parts, customers should ensure that the selected product is suitable for their particular vehicle.

Where the product description contains relevant information, this information regarding vehicle type, model year, engine type, original or reference part numbers and other technical specifications must be taken into account.

If there is any doubt as to whether a vehicle part is suitable, the customer should contact Telges Corse GmbH before placing the order.

Where special installation, safety or approval requirements apply to particular products, these requirements must be observed.

10. Liability

Telges Corse GmbH shall be liable without limitation for damages resulting from injury to life, body or health, as well as for damages caused by an intentional or grossly negligent breach of duty.

In the event of a slightly negligent breach of essential contractual obligations, Telges Corse GmbH shall only be liable for foreseeable, typically occurring damage.

The limitations of liability shall not apply insofar as mandatory statutory provisions provide otherwise.

11. Right of Withdrawal for Consumers

Consumers generally have a statutory right of withdrawal.

Details are set out in the separate Withdrawal Policy, including the model withdrawal form.

12. Exclusion of the Right of Withdrawal

The right of withdrawal does not apply, in particular, to goods that are not prefabricated and for whose production an individual selection or determination by the consumer is decisive, or which are clearly tailored to the consumer's personal requirements, provided that the statutory requirements for this exception are met.

Further statutory exceptions to the right of withdrawal remain unaffected.

13. Storage of the Contract Text

Telges Corse GmbH stores the contract text after conclusion of the contract in accordance with the statutory retention obligations.

The order data and contractual information are provided to the customer in text form together with the order confirmation or other contractual documents.

The customer may also save or print the contractual information using the corresponding functions of their browser.

14. Contract Language

The language available for the conclusion of the contract is German.

Where the online shop provides an English-language version, information and communication may additionally be provided in English.

15. Consumer Dispute Resolution

Telges Corse GmbH is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

The information obligation pursuant to Section 36 (1) No. 1 of the German Consumer Dispute Resolution Act (VSBG) does not apply to businesses with ten or fewer employees as of 31 December of the preceding year.

The consumer's statutory rights pursuant to Section 37 VSBG in the event that a dispute cannot be resolved remain unaffected.

16. Final Provisions

The law of the Federal Republic of Germany shall apply.

For consumers, this choice of law shall only apply insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the country in which they have their habitual residence.

For business customers, the place of jurisdiction shall, insofar as legally permissible, be the registered office of Telges Corse GmbH.

Should any provision of these General Terms and Conditions be or become invalid, the statutory provisions shall apply in its place. The validity of the remaining provisions shall remain unaffected.
